Who I am
Nest Wills ("I", "me") is a will-writing and estate planning practice operated by James Samson, based in Oundle, Northamptonshire. For the purposes of UK data protection law, I am the "data controller" of the information you provide.

What information I collect
Through the Family and Estate Planner and my work with you, I collect information including: your name, contact details and date of birth; details about your family and relationships; financial information about your assets, property, business interests and liabilities; details of your existing arrangements (such as Wills, trusts and powers of attorney); your wishes regarding your estate; and, where relevant, information about health, vulnerability or personal circumstances that may affect my advice. Some of this is "special category" data, which I handle with additional care.
You may also give me information about other people - such as your children, beneficiaries, executors and attorneys. Please only share what is necessary, and where appropriate let them know I hold basic details about them for your estate planning.
Why I use it, and my lawful basis
I use your information to provide estate planning advice and prepare your documents. My lawful bases under UK GDPR are:
Contract - to provide the services you have asked me for;
Legitimate interests - to advise you properly and run my practice;
Legal obligation - for example, identity checks and record-keeping;
Consent - which you provide when you submit the Planner, and which you may withdraw at any time.
For special category data (such as health information), I rely on your explicit consent and on the basis that processing is necessary for establishing, exercising or defending legal claims.
Who I share it with
I do not sell your information or use it for marketing. I may share it only where necessary to provide my service - for example with a solicitor, accountant or other adviser you have asked me to involve - and with trusted service providers who help me run my practice (such as my secure form and document providers), who are bound to protect it. I may disclose information where required by law.
Where it is stored and how I protect it
Your information is stored securely, with access restricted to those who need it. Data is held on reputable platforms with appropriate security measures, located in the UK or European Economic Area, or with equivalent safeguards. I use encryption and access controls to protect it.
How long I keep it
I keep your information for as long as necessary to provide my services and to meet my legal and professional obligations. Given the nature of estate planning, this is typically 7 years after my work for you concludes, after which it is securely deleted or anonymised, unless you ask me to retain it (for example, where I continue to hold your Will).
Your rights
You have the right to access the information I hold about you; to have it corrected if it is wrong; to ask me to delete it; to restrict or object to how I use it; and to withdraw consent at any time. To exercise any of these, contact james@nestwills.co.uk.
Complaints
If you are unhappy with how I have handled your information, please contact me first so I can put it right. You also have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk or 0303 123 1113.
